It is important to consider making a new will when instigating divorce proceedings. If you have made a Will leaving some or all of your estate to your spouse this will remain valid until the Decree Absolute has been granted (final stage of divorce). If you do not have a will the whole of your estate will automatically pass to your spouse.

Most divorcing couples do not want their spouse to inherit all or any of their estate. If this is the case a new will needs to be prepared.

Once your divorce is complete it is important that you amend your will to reflect the same.
